Decree 255 and SUT: managing occupational safety and health in Ecuador

Executive Decree 255 establishes Ecuador’s Occupational Safety and Health Regulations. To apply them, an organisation needs to understand its risks, assign responsibilities and demonstrate that preventive measures are put into practice.

In brief

The Unified Labour System, SUT, allows employers to register obligations with the Ministry of Labour. This registration must reflect actual management: uploading information to the platform does not replace assessment, training or implementation of the corresponding measures.

Identify the organisation’s size and risk level

The appointment of responsible personnel and the applicable obligations must be checked against workforce size, risk level and relevant legislation. Using the same documentation checklist for every organisation is not appropriate.

The ministry’s portal distinguishes registration for employers with one to ten workers from registration for those with more than ten. This distinction helps users find instructions, but does not replace a review of the specific circumstances.

Assign responsibilities that can be fulfilled

Decree 255 regulates the organisation of prevention and the appointment of responsible personnel. In practice, it is useful to specify who coordinates activities, who provides information and who checks implementation.

Responsibilities and functions must extend to sites and those who organise work. An appointment that exists only in a document leaves unanswered how to respond to an incident or a process change.

Connect legislation, measures and evidence

The official catalogue brings together Decree 255, Agreement MDT-2024-196 and annexes containing technical and verification tools. It is the reference for identifying applicable versions, forms and requirements.

Document management must make implementation evidence retrievable. For example, a training activity needs to correspond to the intended risks and participants; keeping a blank form does not demonstrate that the activity took place.

Register in SUT what has been implemented

The Ministry explains that information registered in SUT must be supported by evidence of implementation that can be checked during inspection. The modules and documents depend on each employer’s circumstances.

As an organisational approach, it is useful to separate preparation, technical review and registration. Afterwards, retain the confirmation and connect it with supporting evidence, avoiding conflicting versions between the platform and internal files.

Review changes and applicable provisions

The legal requirements register must include both the regulations and subsequent implementing provisions. Decree 255 contains transitional provisions; updating does not simply mean deleting all previous references and changing the legislation’s name.

For any specific requirement, consult the current text, technical annexes and official instructions. Templates downloaded some time ago should be checked before being reused for a new registration.

Hypothetical example: opening another site

A company opens a site with different activities. Before reusing documentation from its headquarters, it reviews risks, responsible personnel and applicable obligations. It organises the measures and checks which information must be reflected in SUT.

Follow-up connects each registration with the site and its supporting evidence. An inspection can then find a coherent explanation linking what has been declared to the working conditions observed.
